These Terms of Service (“Terms”) govern your access to and use of VNISH websites, pages, and resources (the “Site”), including firmware downloads, documentation, updates, troubleshooting resources, and the VNISH Partner Program application flow (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1) Definitions

“VNISH,” “we,” “us,” “our”: the VNISH operator/entity listed in the “Contact” section.

“You,” “User”: any person or entity using the Services.

“Firmware”: VNISH software and updates made available for supported ASIC miners.

“Miner”: an ASIC device (e.g., Bitmain Antminer models and supported Scrypt models).

“Partner Program”: VNISH program for farms, hosting providers, integrators, and other operators managing large fleets.

“Content”: text, graphics, documentation, and materials on the Site.
2) Eligibility and Account Responsibility
You must be legally capable of entering into a binding agreement to use the Services. If you use the Services on behalf of a company, you represent that you have authority to bind that company.
If any part of the Services requires credentials or access tokens, you are responsible for maintaining their confidentiality and for all activity under your access.
3) Scope of the Services

VNISH may modify, suspend, or discontinue any part of the Services at any time.
4) Firmware Download and Use
4.1 Correct model selection
You are responsible for selecting the correct firmware version for your Miner model and confirming compatibility. Installing incorrect firmware may cause downtime, performance instability, or other operational issues.
4.2 Operational risk
ASIC mining involves operational risks. You are responsible for:

Confirming stable power and thermal conditions
Following installation instructions
Backing up settings before applying changes

Using rollback or recovery options where appropriate
4.3 Integrity checks
Where checksums (e.g., MD5) are provided, you should verify file integrity before installation.
4.4 No guarantee of performance outcomes
Any performance, efficiency, or ROI statements are examples only and depend on your specific conditions. Results may vary.
5) Acceptable Use
You agree not to:
Use the Services for unlawful purposes

Attempt to gain unauthorized access to systems or infrastructure
Upload malware or exploit code
Interfere with Site availability or security

Scrape or copy the Site in violation of law or availability limits

Misrepresent your identity, fleet size, or authority
VNISH may restrict or block access to protect the Services and users.
6) Partner Program Terms
Submitting an application does not guarantee acceptance. If accepted, you may receive partner pricing, direct support access, and scaling options.
Commercial terms may be provided in separate written agreements, which will control in case of conflict.
7) Support and Communications
Support may be provided via:

Email, ticketing, WhatsApp, or Telegram
VNISH may contact you regarding support, applications, service notices, and security updates. Marketing communications will follow applicable law.
8) Intellectual Property
The Services, firmware, documentation, and trademarks are owned by VNISH or its licensors and are protected by intellectual property laws.
You may not:

Copy, modify, distribute, or sell firmware or Content without permission

Reverse engineer firmware except as allowed by law
Feedback: Any feedback you provide may be used by VNISH without restriction or compensation.
9) Third-Party Services and Links
The Services may link to or integrate with third-party services. VNISH is not responsible for third-party services or their terms.
10) Disclaimers
THE SERVICES AND FIRMWARE ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
VNISH DISCLAIMS ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11) Limitation of Liability
To the maximum extent permitted by law, VNISH will not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, mining rewards, data, or uptime.
Aggregate liability is limited to the amount paid to VNISH in the three (3) months before the claim, or $100 if no fees were paid, unless prohibited by law.
12) Indemnification
You agree to indemnify and hold VNISH harmless from claims arising from your misuse of the Services or violation of these Terms.
13) Suspension and Termination
VNISH may suspend or terminate access for violations, security risks, or legal requirements. You may stop using the Services at any time.
